NDIPAP was formed to establish a consistent industrial pretreatment assistance program for industries in the state of North Dakota. This assistance is funded jointly by the U.S. Environmental Protection Agency (EPA) and the Red River Water Management ConsortiumSM (RRWMCSM).

The state of North Dakota does not currently have an EPA-approved industrial pretreatment program, and as such, regulatory authority for industrial wastewater discharges to publicly owned treatment works (POTWs) falls under the jurisdiction of EPA Region 8. North Dakota categorical industries not covered by existing municipal pretreatment programs have limited alternative regional resources that they can turn to for advice, assistance, and/or educational outreach. This situation increases the chances for toxic industrial discharges to North Dakota POTWs and the potential for negative impacts on North Dakota receiving waters.

Through this program, existing and potential significant industrial users (SIUs) and categorical industrial users (CIUs) not covered by existing pretreatment programs will be introduced to the program and the technical resources available to them.

How NDIPAP Works

NDIPAP is directed by an advisory board made up of North Dakota wastewater treatment professionals, with a strong representation from the North Dakota Water Environment Association (NDWEA). The advisory board develops educational outreach materials, including industrial effluent-monitoring guidelines; develops and conducts industrial pretreatment workshops; provides professional advice related to industrial pretreatment standards compliance; and provides on-site assistance as needed.

Who Is Required to Pretreat Wastewater?

Industries that discharge water to POTWs and fall under the regulations described below may be required to pretreat wastewater.

CIUs are subject to categorical pretreatment standards (40 CFR Chapter I, Subchapter N). Examples of CIUs are metal-plating operations or metal-painting facilities that phosphatize metals prior to painting.

SIUs are those industries not listed as categorical but are significant users in one or more of the following ways:

  • Discharge 25,000 or more gallons of process wastewater per day.
  • Contribute 5% or more of the average dry weather hydraulic or organic capacity of their POTW.
  • Have a potential for adversely affecting POTW operations or violating pretreatment requirements.


Examples of SIUs are food-processing plants or industrial laundries.
